What is an Environmental Impact Assessment (EIA)?

The environmental impact assessment of a project is carried out under the Act of 3 October 2008 on the provision of information on the environment and its protection, public participation in environmental protection and environmental impact assessments - the so-called Assessment Act.

Conducting an EIA is required for projects likely to have a significant impact on the environment, listed in the Regulation of the Council of Ministers of 10 September 2019 on projects likely to have a significant impact on the environment.

According to the aforementioned regulation, these projects are:
  • may always have a significant impact on the environment - in this case an EIA is always required. The application for the Decision on Environmental Conditions must be accompanied by an Environmental Impact Report.
  • likely to have a potential significant impact on the environment
The regulation also sets out the cases in which changes made to facilities are qualified as projects that may always or potentially have an impact on the environment.
